Terms of Service
These Terms of Service ("Terms") govern your access to and use of the PerfectAiStudio mobile application and related services (the "Service"), operated by Anil Simsek, LLC, a limited liability company registered in Delaware, United States ("we," "our," or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
PerfectAiStudio provides AI-powered photo and video editing tools, including image enhancement, restoration, retouching, background modification, and AI image and video generation. Results are produced by artificial intelligence models and delivered to your in-app library.
We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where practicable.
2. Eligibility and Accounts
2.1 You must be at least 13 years old (or 16 in the European Economic Area and similar jurisdictions) to use the Service.
2.2 You may use the Service as a guest or with a registered account. You are responsible for maintaining the security of your device and account credentials, and for all activity under your account.
2.3 You may delete your account at any time in Settings. Account deletion permanently removes your content and data as described in our Privacy Policy.
3. Credits, Subscriptions, and Billing
3.1 Certain features consume credits. Credit allowances are determined by your plan and are refreshed according to your billing cycle. Unused credits do not carry over unless expressly stated.
3.2 Paid subscriptions automatically renew each billing period (monthly or annual) until cancelled. Your payment method is charged through your Apple App Store or Google Play account. To cancel, use your store account settings (iOS: Settings → Apple ID → Subscriptions; Android: Play Store → Payments & subscriptions). Cancellation takes effect at the end of the current billing period.
3.3 Prices may change. Any price change applies from your next billing period, and the store will notify you in accordance with its policies.
3.4 Except where required by law or by the applicable store's refund policies, purchases and consumed credits are non-refundable. Refund requests for App Store purchases are handled by Apple; for Google Play purchases, by Google.
3.5 Free trial or introductory offers, where available, convert to a paid subscription at the end of the trial period unless cancelled beforehand.
4. Your Content
4.1 You retain all ownership rights in the photos, videos, and prompts you upload ("Input Content") and, to the extent permitted by law, in the AI-generated results you create ("Output Content").
4.2 You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your Input and Output Content solely to operate and provide the Service (including transmitting content to our AI processing providers). We do not use your content to train AI models. This license ends when you delete the content or your account, subject to the retention periods in our Privacy Policy.
4.3 You represent and warrant that you own or have all necessary rights to the content you upload, and that your content does not violate any law or the rights of any third party (including privacy, publicity, and intellectual property rights of people depicted in your images).
5. Acceptable Use
You agree NOT to use the Service to:
- Upload or process images of any person without their consent
- Create content that is defamatory, harassing, or invades another person's privacy
- Create deceptive media intended to mislead, including fake depictions of real people presented as authentic ("deepfakes")
- Create sexual, exploitative, or abusive content, or any content involving minors
- Infringe any copyright, trademark, or other proprietary right
- Violate any applicable law or regulation
- Reverse engineer, scrape, overload, or interfere with the Service, or circumvent usage limits, credit accounting, or security measures
We may remove content, suspend, or terminate accounts that violate these rules, with or without notice.
6. AI-Generated Content
6.1 Output Content is generated by artificial intelligence and may be inaccurate, unrealistic, or unsuitable for your purpose. It may not depict reality and must not be relied upon in contexts requiring factual accuracy.
6.2 Similar or identical outputs may be generated for other users. We make no guarantee of uniqueness.
6.3 You are solely responsible for how you use, publish, or distribute Output Content, including compliance with disclosure obligations that may apply to AI-generated media in your jurisdiction (for example, under the EU AI Act).
7. Intellectual Property
The Service, including its software, design, trademarks, and all content other than user content, is owned by Anil Simsek, LLC or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on devices you own or control.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS. UPLOADED SOURCE FILES ARE AUTOMATICALLY DELETED AFTER THE RETENTION PERIOD DESCRIBED IN OUR PRIVACY POLICY — KEEP YOUR OWN BACKUPS OF ORIGINAL FILES.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIL SIMSEK, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS (USD \$50), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, these limitations apply to the fullest extent permitted.
10. Indemnification
You agree to indemnify and hold harmless Anil Simsek, LLC and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you materially breach these Terms, if required by law, or if we discontinue the Service. Sections 4.3, 6.3, and 7–10 survive termination.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where mandatory consumer-protection law of your country of residence provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced in the app before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
